It is imperative that you continue to document refusals, declines, cancellations, etc. (date, school, F or H day, teacher, grade, and reason(s) in case the Board requests your reasonable grounds. If you are unable to work, please make yourself “unavailable” so that the system does not take the time to call you needlessly.

Employee Workplace Conduct (Including Workplace Harassment)

GAP 542 -  DO NOT use cellphones, PEDs during class time

It was brought to the Association's attention that occasional teachers are using their cell phones during instructional, class time thereby violating one of the Board's Procedures, GAP 542. Occasional teachers are not to use their Personal Electronic Device (PED) such as cell phones, blackberry, laptops, etc. during class time. If necessary, use your PED during recess, lunch or planning time when students are NOT present.

Important wage restraint information on OECTA website

James Ryan, president of the OECTA, shares important information on the government’s proposed wage restraint legislation in an online video message to OECTA members posted at www.oecta.on.ca in the Members’ Centre.

OECTA has been invited to participate in a consultation process with the government on the proposed legislation, from September 20 to October 1.

To access the information in the Members’ Centre, members must create an account to login. On the home page of the website, click on the red link located at the top right called Create an Account. If you have any problems creating an account, send an email to contact@oecta.on.ca for assistance.

Once logged in, members will find these OECTA’s wage restraint resources:
• a video message from James Ryan, OECTA president,
• OECTA’s news release issued in July following the Minister’s announcement,
• links to government source material and FAQs on the consultation process,
• a link to the Ontario budget where proposed wage restraint legislation was announced, and
• media reports, providing a broad range of news and editorial views from teachers, media, government, the education sector and public.

The Members’ Centre on OECTA’s website, www.oecta.on.ca will be updated regularly to keep members informed about the proposed wage restraint legislation and ongoing progress in the talks with the government.

Contract Clauses in effect September 2011

Effective September 1, 2011 the daily rate of pay is $ 227.42. ( Article 14.02)

To remain on the O.T. List, you must teach the equivalent of at least seven (7) full days every five (5) months throughout the school year of 2011-2012. Retirees must teach the equivalent of at least fourteen (14) full days in 2011-2012. (LETTER OF UNDERSTANDING #5)

Were you interviewed for the L.T.O. position?

In our new contract, if the L.T.O. is not pre-filled, the Board is to interview candidates,  and more than 50% of the candidates must be from the OT List.

Please inform the Dufferin-Peel Occasional Teachers' Bargaining Unit (OTBU) office of any LTO position you apply for. OT's must be interviewed according to the criteria in 16.02 (b) of the new Collective Agreement.

Include the posting #, closing date, were you interviewed (Yes/No), who interviewed you, and if you know, how many applicants were interviewed.

This could help confirm compliance with the section 16.02(b) of the new C.A.

Inactive Status

Please note the change in policy and procedure:

As of December lst, 2008 only OTs who are unavailable to work due to illness, maternity, paternity, adoption, or compassionate care (Article 13.06) will be placed on the inactive status.  OTs doing LTOs with another board will NO longer be placed on the inactive list.

OTs who are unavailable to work due to vacation trip or brief illness will no longer be required to notify the board in writing, unless its for the entire school year.  Please make sure that you make yourself unavailable on WebTracs, thereby preventing the system from calling you. Should you go away on holidays, please ensure you check off the box so the system will NOT call you for future jobs during this time.   Also, don't forget you must comply with Letter of Understanding #5 (OTs must work 4 full days between Sept. to Jan. (5 months) and 4 full days between Feb. and June (5 months) OR retirees must work 8 full days for 2009-2010 school year) in order to remain on the O.T. List.

Highlights of the 2008-2012  Collective Agreement

• Information contained in the pink “Atlas” will be available on the Board’s website.
• a written request must be made annually no later than June 30th of the previous school year in order to receive a paper copy of the Atlas (Article 7.03).
• Capping of OT List (Article 13.05).
• Board to provide “Summary Rationale for Available Certified Occasional Teachers – Not Used” report made monthly (Article 13.08).
• Pay increase for daily occasional teachers (97% of the Teachers Grid Level 4 A1 0 years experience) (Article 14.02).
• OTs at the same school in the a.m. and p.m. who replace more than one teacher will be paid the daily rate for a full day, and shall only be assigned the supervision duties of 1 teacher. (Article 14.03)
• OTs who replace a teacher, or more than 1 teacher, in the secondary schools in a day shall not be assigned more than 3.5 periods, including duties. (Article 14.03 & Article 15.02 b)
• OTs shall not knowingly accept any assignment(s) for which they are unable to completely fulfill the duties. (Article 14.03)
• OTs shall be in the classroom 15 minutes prior to the start of the school day and 5 minutes prior to the start of the afternoon, except when on supervision duty.
• LTO vacancies will be filled by members who are recommended by the Principal, otherwise the Principal will be required to interview, with at least 50% being Bargaining Unit members. The Board will electronically track the compliance if member applied through Board website. (Article 16.02)
• To remain on the OT List, an OT must teach 4 full days every 5 months (Sept. to Jan. and Feb. to June) in 2009-2010 and retirees must teach 8 full days from September to end of June in the year. (Letter of Understanding #5)

Collective Agreement

The Collective Agreement (C.A.) forms the basis of your employment and outlines your working conditions with the Dufferin-Peel Catholic District School Board. A copy of the current collective agreement should be provided to you by the Board. It is highly recommended that you familiarize yourself with the collective agreement as it is one of the most important documents for an occasional teacher. When the Board violates the C.A., the Association takes action. The Association expects all members to abide by their C.A. which has been negotiated in the best interest of all members. To ensure the C.A. is maintained, the Executive needs you, our members, to know what is in the C.A., and to be our eyes and ears, as you are the ones in the schools every day.
Know your rights! Stand up for your rights! Our agreement is only as strong as we make it.

Article 13.09 - offers the OT an opportunity to provide reasonable grounds for refusal/decline.

You are encouraged to make yourself 'unavailable' should you be unable or unwilling to work on any particular day or for a period of time. This will prevent you from having to 'decline' jobs, as well as, accumulating 'unanswered calls'.

Article 13.10 - Occasional Teacher who refuses three (3) or more assignments or who cannot be contacted for assignments during a period of twenty (20) school days will be removed from the OT List.  It is imperative that you document and keep a detailed log each time you decline a job.  See NEW PROCEDURE as of March 9th, 2011.

Your Dufferin-Peel File

Did you know that the Board keeps a personnel file on you and that file is kept in the Human Resources Department at the Board office? You have the right to know what is in your file (Article 12.01 of the Collective Agreement). The OTBUnit recommends that every 2 or 3 years you make an appointment with Human Resources to go in and review the materials in it.
If you find something that you did not know about, ask for a copy and contact the Dufferin-Peel OTBU's office immediately.

Secondary OTs

If Secondary OTs are assigned more than 3.5 periods for a full day (Article 15.02 b), please bring it to the administrator's attention. Should the administrator be insistent, do not argue, do as you are instructed and send me your daily assignment sheets (make sure the date, school and Job # appear on the sheet) along with an explanatory note. Please send them to Jean Smylie, c/o Dufferin-Peel Occasional Teachers' Bargaining Unit by courier.

QECO Evaluation Statement Deadline

Occasional Teachers doing LTO Assignments are reminded to promptly submit their QECO evaluation certificate to the Board in order to be paid at the proper grid category. This must be done prior to the end of the LTO Assignment in order to be paid retroactively to the first day of the LTO.
Article 16.06 e) of the Collective Agreement states, "It shall be the responsibility of the Long Term Occasional Teacher to provide the Board with her/his Qualifications Rating Statement and any supporting documents no later than the end of the assignment."
